§ 1.
General Provisions
The LYNIA online store [hereinafter referred to as the "Store"], operating at the addresses: www.lynia.pl, lynia.de, lynia.at, etc., conducts retail mail order sales of cosmetic raw materials and semi-finished products, as well as cosmetic accessories or finished cosmetics, via the Internet and based on these Terms and Conditions [hereinafter referred to as the "Terms and Conditions"].
The online store does not sell raw materials for the production of cosmetics, nor does it conduct wholesale sales of raw materials. All products sold in the LYNIA store ARE NOT INTENDED FOR CONSUMPTION in any form, nor for use in food or medical products!

The Terms and Conditions constitute an integral part of the sales contract concluded with the Customer.
The condition for concluding a sales contract is the voluntary acceptance of the Terms and Conditions by the Customer.
Registration in the Store is equivalent to accepting the Terms and Conditions.
The prices of products in the Store are gross prices (including tax) and are given in Euro (EUR) or another currency.
The prices of products in the Store do not include shipping costs.
The Store reserves the right to change the prices of products in the offer (however, price changes do not apply to orders already accepted for processing), to introduce new products to the online store's offer and to withdraw selected products from sale, as well as to conduct and cancel promotional campaigns on the store's website or to make changes to them. The Customer will be informed of all changes made on the Store's website, in the "Changes" tab.
A limited number of goods are intended for promotional sales and clearance sales. Orders are processed in the order of confirmed orders received, until the stock covered by such a form of promotion is exhausted.
The goods available in the Store are free from physical and legal defects and have the required relevant certificates.
The goods offered in the Store are intended for external use only. The Store is not liable for the use of offered products contrary to recommendations or beyond the recommendations posted on the Store's website. The Store's liability is limited to the guarantees regarding the cosmetic properties of the offered products and does not cover losses resulting from their use beyond the Store's control; therefore, the Store is not liable for special, indirect, or consequential damages arising from the use of products offered by the Store.
The Store does not send or provide free samples of the products included in its offer.
§ 2.
Orders: Placing and Processing
The information on the Store's website does not constitute an offer within the meaning of the Civil Code. The sales contract is concluded upon confirmation of the order by the Store's service. Proof of confirmation of the contract will be an e-mail message with an attachment in PDF format (so-called pro forma invoice), confirming the acceptance of the order for processing, sent to the e-mail address provided by the Customer.
The Store conducts sales and shipping to all countries worldwide, subject to prior agreement on shipping costs.
Orders can only be placed via the form available on the Store's website, 24 hours a day, all year round. Orders placed by phone or e-mail will not be processed.
The condition for processing the order is the Customer providing correct data (first and last name, full address, telephone number, e-mail address) allowing for the verification of the Customer and the recipient of the goods. By providing personal data, the Customer confirms that it is their true and correctly recorded personal data.
The Store confirms acceptance of the order by e-mail (therefore, the Customer is obliged to provide an e-mail address and telephone number with the area code during registration in the Store), no later than three business days from the date of placing the order. The e-mail confirming the order with the obligation to pay includes a request for confirmation of the purchase (necessary for the conclusion of the sales contract), the order number, order summary, shipping address details, and detailed payment information. All order details, along with the total costs incurred by the Customer for the execution of the placed order, are contained on a durable medium in the form of a PDF attachment, which is attached to the e-mail sent to the Customer as order confirmation.
If the Customer does not receive a confirmation e-mail within a few minutes of placing the order, it may mean that the Customer's e-mail address was entered incorrectly or technical problems occurred. In such a situation, the Customer is requested to contact the Store by phone or e-mail.
The Store may cancel the order if:
the Customer's data is incorrect, incomplete, or raises doubts, and the Customer cannot be contacted;
the payment has not been credited to the Store's account (specified, among other things, in the order confirmation e-mail) within 7 days of placing the order, for orders paid by bank transfer;
this is the Customer's request, provided that the order has not already been processed and shipped.
The Store also has the right to refuse to accept an order without giving a reason, about which the Customer will be informed electronically.
The Store does not process orders with a value of purchased goods below EUR 5, excluding shipping costs.
The information contained on the Store's website for the purchased goods at the time of placing the order is binding on the parties, in particular: price, characteristics of the goods, their features, components included in the set, delivery time, and method of delivery.
Orders placed on weekdays after 2:00 PM, on Saturdays, Sundays, and public holidays will be processed on the next business day.
Form of contact with the Customer: The Store will contact the Customer electronically or by phone. The call rate to the Store's telephone number +48 699 712 356 is in accordance with the Customer's operator's tariff and is not classified as a special or premium number.
§ 3.
Payments
The Customer can choose the following payment methods:
by bank transfer – in which case the Store reserves the goods in the warehouse and sends them to the address indicated by the Customer after the payment is credited to the bank account indicated on the Store's website or in the order confirmation e-mail sent to the Customer. The payment deadline in this case is 7 business days from the date of placing the order.

If an error occurs while paying for the order via PayPal, the Customer can make a payment by bank transfer, but only if the order number is provided in the transfer title.
The delivery cost should be added to the price of the goods. Shipping prices are specified in the delivery price list.
The condition for releasing the goods is payment for the goods and shipping. The goods are shipped after the Customer's payment is credited to the bank account IBAN: PL54 1140 2004 0000 3112 1799 6526. After receiving the payment, an e-mail will be sent about the change of status to: "Processing". If the order placed by the Customer is not paid within 7 days from the date of placing the order at the latest, the Store does not guarantee the availability of the ordered goods.
Credit card and other payment method transactions are processed via Stripe Inc.
Bank transfer payments are posted every business day at 2:30 PM. Payments made after 2:30 PM are posted on the next business day.
Tax invoices are issued by the Store at the Customer's request. For this purpose, during the order placement process in the data form, the "company" option should be selected and the invoice details should be provided. Information about the desire to receive a Tax invoice should be placed in the "Comments" section ("Additional information"). If the shipping address is different from the invoice details, the "different shipping address" option must be selected in the form and the address to which the order is to be sent must be provided. The date of issue of the tax invoice is the date of shipment of the order. It is not possible to change this date. In the event of a need to refund funds for a transaction made by the customer with a payment card, the seller will make the refund to the bank account associated with the Ordering Party's payment card.
§ 4.
Shipping of Goods
The Store ships ordered goods via InPost or DPD shipping companies.
By concluding the sales contract and making a purchase, the Customer declares that they authorize the Store to forward, on their behalf, the delivery costs and the package itself with the ordered goods to the Courier Company Representative.
The types of shipments and their delivery costs are automatically provided by the system after selecting: the destination country, the method of delivery, and the method of payment.
Shipping costs are increased by tax and depend on the weight of the shipment.

Personal collection of ordered goods is not possible.
Information about the shipping date is provided to the Customer immediately after placing and accepting the order and is calculated from the date the payment is credited to the Store's bank account. The package delivery time consists of the shipping time and the delivery time. The shipping time depends on the availability of products and the selected payment method (each product has a lead time indicating when the products can be prepared and shipped – from 2 business days to several, and sometimes even several days – in the case of hard-to-reach products), and the delivery time depends on the delivery method chosen by the Customer.
The Store has the right to extend the order processing time due to adverse weather conditions, such as severe frost or high temperatures, taking into account the durability and quality of the delivered products, which may deteriorate as a result of very low or high temperatures. In such cases, the Store will contact the Customer immediately and agree on individual shipping conditions. In such cases, the Customer has the right to cancel the order and receive a full refund of the amount paid.
The Store is not responsible for the Customer providing false or incomplete shipping data, especially when incorrect contact details are provided, which make it impossible to verify the incorrect data. If the shipment is returned to the Store's address due to an incorrectly provided shipping address, all additional shipping costs are borne by the Customer. In case of refusal, the amount reduced by the costs associated with shipping and return of the goods will be refunded within 7 business days to the bank account provided by the Customer.
All fragile, glass, delicate plastic goods, or laboratory equipment are shipped – to prevent their damage – only and exclusively by courier.
§ 5.
Complaints and Returns of Products
The basis for accepting a complaint is the Customer presenting any proof of purchase of the goods. All complaints should be submitted by e-mail to the store's address: info@lynia.de or in writing sent to the company's correspondence address.
Before accepting the shipment, always check if it has been damaged in transit. The Customer is obliged to check the contents of the shipment in the presence of the delivery person upon receipt or during collection from a parcel locker. If damage to the shipment or its contents or any quantitative shortages are found, a report must be drawn up in the presence of the delivery person or notes must be entered in the case of collection from a parcel locker. The report should be signed by the delivery person and may form the basis for a complaint.
In the event of damage to the goods during transport, the complaint should be reported by e-mail to: info@lynia.de or in writing to the company's address. Each case is considered individually within 14 days from the date of the complaint.
If the purchased goods turn out to have manufacturing defects or are inconsistent with the description, please contact the store by sending an e-mail to: info@lynia.de. Each Customer has the right to return the complained goods to the company's correspondence address provided in § 1 of the Shopping Regulations.
Within 14 days of submitting the complaint, the Customer will be informed by e-mail or telephone about the outcome of the complaint procedure. In case of doubt, please contact the store electronically: info@lynia.de or by phone: +48 699 712 356. We will then provide instructions on how to handle the complaint quickly and easily.
Returns of products. Within 14 calendar days from the date of delivery of the ordered goods, the Customer has the right to return them without giving a reason as part of the withdrawal from the contract in accordance with the general principles arising from the regulations regarding distance contracts (excluding goods regulated by Article 10 paragraph 3 point 5). This applies only to consumer sales and also to the case of sales to a sole proprietorship for purposes not related to its business.
The Store responds to the Customer's complaint within 14 days from the moment of returning the goods along with a description of the non-conformity.
If the processing of a justified complaint involves sending the Customer new goods or removing the non-conformity, the delivery costs are borne by the Store.
The right to withdraw from a distance contract does not apply to the Customer in the following cases: a) for services with properties specified by the Customer in their order or closely related to their person, b) for services which, due to their nature, cannot be returned or whose subject matter is perishable.
Regardless of the store's decision regarding the complaint or return, you have the possibility to pursue your rights or claims before a common court or through so-called Alternative Dispute Resolution (ADR) methods.
§ 6.
Privacy Protection (GDPR)
By placing an order, the Customer agrees to the processing of their personal data for the purpose of order fulfillment in the lynia.pl online store.

Your personal data will be processed for the purpose of order fulfillment - on the basis of Article 6 paragraph 1 letter b of the General Data Protection Regulation of April 27, 2016.
Recipients of your personal data will be entities participating in the order fulfillment process.
Your personal data will be stored for a period of 6 years.
You have the right to request from the administrator access to your personal data, the right to rectify, delete, or limit processing, and the right to data portability.
You have the right to lodge a complaint with a supervisory authority.
Providing personal data is voluntary, however, refusal to provide data may result in refusal to process the order.
The Customer may also give separate consent to receive advertising and promotional materials from the Store, including a commercial newsletter.
Personal data provided by the Customer is treated as information of the highest degree of confidentiality, and no one outside the Store has access to it.

§ 7.
Intellectual Property, Documentation
All materials (including photos, recipes, instructions, product descriptions, texts, logos, leaflets, banners, etc.) posted on the Store's website and sent in e-mails are protected by copyright. It is forbidden to use them without the written consent of the Store or LOGIS-TECH.
§ 8.
Entry into Force of the Terms and Conditions
The Terms and Conditions come into force on the date of publication on the Store's website.
In matters not regulated by these Terms and Conditions, the provisions of the Civil Code shall appl.
